Payment under an individual government guarantee

The creditor or the creditor’s representative may make a claim against the Danish State/Finansiel Stabilitet as soon as a debtor whose obligations are comprised by an individual government guarantee defaults on a payment obligation. The exact time of default is determined on the basis of the individual guaranteed agreement between the creditor and the debtor. 

The creditor is not obliged to seek recovery of the claim from the debtor. 

A claim may be made against Finansiel Stabilitet by completing a default notice demand. A scanned copy of the signed default notice must be submitted to Finansiel Stabilitet by e-mail (garanti@finansielstabilitet.dk). The original and signed default notice must be sent by ordinary mail to Finansiel Stabilitet. A copy of the default notice must be sent to the debtor. 

When Finansiel Stabilitet has received a claim for payment under the guarantee and is obliged to effect payment under the guarantee, the payment will be made as soon as possible after receipt of the claim for payment.
 
If a paying agent or similar intermediary has been appointed for the guaranteed obligations, such agent may also submit a default notice. Payment to a paying agent or similar intermediary will generally be deemed to be a payment made to the creditor. 

Payments made under a guarantee will be announced on Finansiel Stabilitet’s website.
